<br />Commission Minutes--September 16, 2002 2511 <br /> <br />in his correspondence to the board, Mr. Burdick gave his opinion that the proposed <br />,..... moratorium could not be validly impiemented at this time because the action would bind a <br />future board of commissioners. There is an election this year, and two of the current <br />commissioners are not seeking re-election. He provided copies of an Attorney General's <br />opinion, dated September 13, 1999, on which he based his response. <br /> <br />Mr. Burdick next referred to the process of introducing a resolution through the commission <br />in order to reach the formal process of first and second readings under the Home Rule <br />Charter. It is Mr. Burdick's opinion that the commission may listen to the discussion of a <br />proposed resolution and then determine whether they wish to introduce it through the formal <br />"reading" process. <br /> <br />,.... <br /> <br />A majority of commissioners were in agreement that they could not support a 24-month <br />moratorium on demolition of the jail and sheriffs residence because that is too long a <br />timeframe, and it wouid bind a future board of commissioners. Mrs. Schneider said she <br />does not see any harm in following the resolution process, which would give them another <br />20 days. Mr. Wieland said he could support the 20-day timeframe if that is the process to <br />show that the board is open to the people. Tara Lenertz. Moorhead, addressed the board <br />and said she would be disappointed to see the jail and sheriffs residence demolished <br />because she believes everything should be preserved. <br />MOTION, passed <br />Mrs. Schneider moved and Mrs. Sorum seconded to give first reading to <br />the proposed "Resolution to Establish a 24-Month Moratorium on the <br />Destruction or Removal of Historic Landmarks Commonly Called the <br />Cass County Jail and Sheriff's Residence" and publish a summary in the <br />county's official newspaper at least 20 days before the second reading. <br />Motion carried. <br /> <br />12. <br /> <br />JAlUSHERIFF'S RESIDENCE, "This Old House" maqazine advertisement <br />Bonnie Johnson, County Coordinator, was contacted by Ryan Robbins, Assistant Editor of <br />'This Oid House" magazine offering to provide advertising for the Sheriffs Residence in his <br />"Save This Old House" section of the magazine. The advertising would be similar to what <br />the county did on a local level, however, the advertisement would be nationwide and at no <br />cost to Cass County. <br />MOTION, passed <br />Mr. Wagner moved and Mrs. Schneider seconded to approve a proposal <br />to advertise the former Sheriff's Residence in "This Old House" <br />magazine, according to the conditions listed in a memo from the County <br />Coordinator dated September 10, 2002. Motion carried. <br /> <br />13. <br /> <br />VOUCHERS, Approved <br />MOTION, passed <br />Mr. Meyer moved and Mrs. Sorum seconded to approve Voucher No. <br />168,038 through No. 168,507. On roll call vote, the motion carried <br />unanimously. <br /> <br />r- <br /> <br />14. RESOLUTION #2002-12 and #2002-13, Marrialle license fees and waitinq period <br />Mr. Wieland asked the board to consider adoptin9 two resolutions relatin9 to marriage <br />license fees and a waiting period, to be forwarded to the North Dakota Association of <br />Counties for consideration at the annual convention in Bismarck the end of September. <br />
