<br />The States Attorney presented a letter she received from the Fargo City Attorney
<br />stating that the rural appointee to the Fargo Planning Commission is eligible if he or she
<br />resides within the extra-territorial area of the City and is not eligible if he or she
<br />does not. He stated that the appointing authority, which would be the County Commission,
<br />has the responsibility of making a valid appointment. Mrs. Stanton stated that she has
<br />requested a copy of a map showing the City of Fargo's extra-territorial area.

<br />Mrs. Wold moved and Mr. Hendrickson seconded that the Board rescind the motion
<br />to appoint Mrs. Fred Hector to the Fargo Planning Commission since she does not live
<br />within the extra-territorial zoning. The Chairman declared the motion out of order
<br />since Mrs. Wold did not vote on the prevailing side.
<br />
<br />As County Safety Director, Gordon Sletmoe informed the Board that he intends to show
<br />a film to County employees on tornado safety, and the Board sugge~ted that he make the
<br />arrangements with the County Auditor.
<br />
<br />On motion by Mr. Satrom and seconded by Mr. Sondrall, the meeting was adjourned.

<br />REGULAR MEETING OF CASS COUNTY COMMISSIONERS

<br />AUGUST 6, 1980

<br />Chairman Stanton called the meeting to order and upon roll call, all members
<br />were present.
<br />
<br />Mr. Hendrickson moved and Mrs. Wold seconded that the minutes of the previous meeting
<br />be approved as written. Motion carried.
<br />
<br />Upon the recommendation of Steve Grindberg, County Road Superintendent, Mrs. Wold
<br />moved and Mr. Satrom seconded that the Chairman be authorized to sign the utility permit
<br />with Cass County Electric to bury cable in the NE\ of Section 1, Stanley Township.
<br />'On roll call vote, the motion carried unanimouSly.
<br />
<br />Upon the recommendation of Mr. Grindberg, Mr. Satrom moved and Mrs. Wold seconded
<br />that the Chairman be authorized to sign the engineering agreement with the Moore Engineering
<br />Company for embankment repair on County Road 10 north of West Fargo, which will be paid
<br />by the Federal Government under the flood program. On roll call vote, the motion carried
<br />unanimously.
<br />
<br />Mr. Grindberg reported that he and Mr. Hendrickson attended a meeting with the
<br />Southeast Cass Water Management District regarding a drainage problem in the City of
<br />Frontier, whereby they are requesting the County to pay 1/3 of the cost for some ditching
<br />along the township road. Mr. Sondrall stated that he received a call that several persons
<br />would like to address the Commission on this matter, and he suggested that they appear
<br />before the Board on August 13th. Mr. Grindberg stated that he will invite the members
<br />of the Southeast Cass Water .Management Board, Mr. Andrew Rutten, the State Highway
<br />Department and members of the City Council of Frontier.
<br />
<br />Discussion continued and several persons again appeared to request the Board to repair
<br />the bridge on 25th Street South between Sections 35-36, Barnes Township, over the Rose Coulee.
<br />Mr. Doug Seiler from the Barnes Township Board of Supervisors was among those present
<br />and stated that the township has received several calls from people interested in having
<br />that bridge repaired, and the township will be submitting a bridge petition to the County.
<br />The Board stated that they are meeting this afternoon at the County Road Department to
<br />determine what projects can be done this year with the money that is available and they
<br />will give this bridge further consideration, and will try to make some kind of decision
<br />next week.
<br />
<br />The Board continued discussion on the requirement of malpractice insurance in the
<br />contracts for conflict attorneys under the Public Defender System. A letter was received
<br />from the States Attorney explaining why she feels it is necessary for Mr. Murphy and
<br />Mr. Britton to have malpractice insurance. The Auditor stated that he will contact
<br />the County's insurance agent to see if they could be insured under the County's policy
<br />for the amount of work they will be doing for the County. Mr. Sondrall moved that the
<br />County pay for malpractice insurance for Ed Murphy and Bruce Britton if the cost does
<br />not exceed $300.00 for the two of them. However, the motion was withdrawn until the Board
<br />determines how much the insurance would cost.
