ADJOURNED MEETING OF CASS COUNTY COMMISSIONERS JUNE 25, 1980 , Chairman Stanton called the meeting to order and upon roll call, all members I were present. Mr. Satrom moved and Mr. Hendrickson seconded that the minutes of the previous meeting be approved as written. Motion carried. Mr. Hendrickson informed the Board of the proposed resolutions drafted by the Resolutions Committee of the North Dakota Association of Counties. A letter was received from the State Social Service Board approving the reappointment of Mrs. Pat Wold as a Commission member on the County Social Services Board for another three year term to expire July 31, 1983; and approving the appointment of Mr. George Griffetr of Fargo to fill the unexpired term of Rev. Emery J. Roy, which will expire July 31, 1982. A hearing was held on the Application for Abatement and Settlement of Taxes submitted by Marlyce Pyle for property in Casselton Township. Mrs. Pyle was present alohg with her attorney Doug Herman, and also present was Mr. Don McIntyre. Clarence Miller, Director of Tax Equalization, recommended that the abatement which requests total exemption of the seed plant operation under the farm exemption law be rejected on the basis of an opinion from the North Dakota Attorney General. Mr. Herman stated that his client feels there has not been equal treatment of taxpayers i since this is not the only family farm that cleans seed for other people and purchases seed from other people and sells at a profit. On a percentage basis, he stated that about 85% is their own grain vs. the other 15% which they purchase. Mr. Hendrickson moved and Mr. Satrom seconded that this be placed in abeyance for 1980 until the Board decides within the year what action will be taken for taxpayers having similar operations as the property in question, known as the McIntyre-Pyle Seed Plant. In further discussion, Mr. Miller stated that the townships are responsibla for listing taxable property on the assessment rolls. He stated that a letter was sent to every township last year i requesting that they forward to him any information of similar operations in the County, but there were no forthcoming replies from the townships. He stated that there are 40 elevators in the County and a number of them are privately owned and are being taxed. Mr. Hendrickson withdrew his motion 'and Mr. Satrom withdrew his second. Mr. Hendrickson moved and Mr. Satrom seconded that the Application for Abatement and Settlement of Taxes submitted by Marlyce Pyle for 1979 be granted as submitted. On roll call vote, the motion failed for lack of a majority vote with Mr. Sondrall, Mrs. Stanton and Mrs. Wold opposing. Mrs. Wold moved and Mr. Sondrall seconded that the Application for Abatement and Settlement of Taxes submitted by Marlyce Pyle be granted in accordance with the recommendation of the County Director of Tax Equalization, whereby the estimated market value of the seed'plant be reduced from the original township assessment of $1,500,000 to $180,000 and that the assessed value be 10% or $18,000 for the years 1979 and 1980. On roll call vote, the motion carried unanimously. Since no one appeared to protest at the hearing on annexation to the Horace Fire Protection District, Mrs. Wold moved and Mr. Satrom seconded that the Board adopt a resolution for the annexation of the W~ of Section 35, Barnes Township, and the incorporated area of Prairie Rose to the Horace Rural Fire Protection District. On roll call vote, the motion carried unanimously. Mr. Rod Sigualason of Fargo appeared before the Board to make them aware that he is proposing to establish an Advanced ,Life Support Transportation Service which is a new area of Emergency Medical Services. Mr. Bob Friese,Director of the Division of Emergency Health Services for the State Health Department, was present and stated that his office issues the licenses for all ambulance services in the State and if they meet all of the requirements of the law, a license will pe issued. He did state that he feels Fargo needs one ambulance service because there is not the volume of calls requiring more. Mr. P. C. Davidson from the F-M Ambulance Service was present and agreed that there is not enough business for two ambulance services, and he stated that he has not received any complaints over the years that they do not provide adequate services.
