RIGHT-OF-WAY EASEMENT <br /> <br />KNOW ALL BY THESE PRESENTS, that We, the undersigned, Owners, Cass County <br />Government, residing at Fargo, North Dakota (hereinaller called "Grantors") for a good and <br />valuable consideration, the receipt which is hereby acknowledged, do hereby grant unto Ideaone. <br />a corporation of 3239 - 39th Street S.W., Famo. ND 58104 (hereinafter called "Grantee"), its <br />successors or assigns, a ninety-nine (99) year casement for telecommunications purposes, <br />including the right to enter upon the lands of~he Grantors situated in the County of Cass, State of <br />NotCh Dakota, particularly described as follows: <br /> <br />Land Description: <br /> <br />Block 2, Lot 1 in Cass County Corrections Addition, to the City of Fargo, Cass County, <br />North Dakota. <br /> <br />Easement Description: <br /> <br />Thc Northerly 10 feet of the above described property. <br /> <br />together with such lands as are necessary for the installation of above ground enclosures, <br />accessories, and buried cable between said right-of-way corridor and said property boundary, <br />including the right to install, repair, maintain, alter, and operate on or under the above described <br />lands and/or in, under or upon all streets, roads, or highways abutting said lands, underground <br />telecommunications facilities; to cut trees and shrubbery that may interfere with or threaten to <br />endanger the installation, operation, and maintenance of said facilities; and to license, permit, or <br />otherwise agree to the joint use or occupancy of said I~.cilities by any other person, firm, or <br />corporation for telecommunications purposes. <br /> <br />Grantors agree that all tmderground Ihcilitics installed on the above-described premises at the <br />Grm~tcc's expense shall remain ~he property oflhe Grmrtee, removable at the option of the <br />Grantee. <br /> <br />Grantors covenant that they are the owners of thc above-described lands and that the said lands <br />are free mid clear of encumbrances al/d liens of whatsoever character except those held hy the <br />following: <br /> <br /> <br />
