PROCEEDINGS OF THE BOARD OF COUNTY COMMISSIONERS OF CASS COUNTY, NORTH DAKOTA Discussion was held with Clarence Miller, County Director of Tax Equalization, and with the County Road Department concerning the County purchasing right of way for road construction projects. Mr. Miller stated that it is becoming increasingly difficult for him to do the appraisal work because he is unable to obtain land sale information on which the appraisal must be based according to Federal law. At his suggestion, Mrs. Wold moved and Mrs. Stanton seconded that a letter be written to the State Highway Department requesting recommendations from them on how to handle the County's right of way purchase problem. Motion carried. The Commissioners were served a Writ of Mandamus signed by Judge John O. Garaas by the City of Fargo vs. Cass County concerning Fargo's request for funds for the construction of bridges over the Red River at First Avenue North and 12th Avenue North in Fargo; and that the defendants appear in Court on January 15, 1979, at 2:00 P.M. The matter will be referred to the States Attorney. Mrs. Stanton moved and Mr. Hendrickson seconded that John Meyer, Veterans Service Officer, be granted out of state travel to attend the conference in Washington, D.C. in March. Motion carried. Mr. Lowell Siebels appeared before the Board and presented petitions with approximately 1,600 signatures calling for an advisory vote of the citizens of Cass County concerning the erection of new bridges within the City of Fargo. Mr. Siebels suggested that this advisory vote be taken at the same time as the school elections rather than spending additional County money for a special election. However, the County Auditor stated that the City of Fargo does not hold their school election at the same time as the others. Mrs. Stanton moved and Mr. Sondrall seconded that the petitions received to date from Mr. Siebels be received and filed. Motion carried. Mrs. Wold moved and Mr. Hendrickson seconded that the Application for Abatement and Settlement of Taxes submitted by Otto Holmen be received, filed and referred to the City of Horace.
