Commission Minutes--June 16, 2005 2912

Mr. Thoreson said he spoke with the State Aeronautical Department, who stressed the
requirement of physical control at each end of the runway and suggested the North Dakota
Insurance Reserve Fund be contacted if the agreement is approved.

Mr. Pawluk asked about warning signs to let motorists know of a road closure. Mr. Soucy
said the County Highway Department has signs that may be used and could install them, if
needed. Mr. Pawluk also said the certificate of liability insurance lists Maple Valley Ag
Products/Buffalo Grain Co., LLC and he suggested the agreement have the same name as
listed on the certificate. Mr. Killoran was agreeable to make that change.
MOTION, passed
Mr. Pawluk moved and Mrs. Sorum seconded to approve the agreement
as amended with Maple Valley Ag Products/Buffalo Grain Co., LLC and to
authorize the chairman to sign said agreement. Discussion: Mr. Wagner
asked about the potential for other aerial applicators requesting use of a
county road as a landing. He realizes the seriousness of this request but
does not want to set a precedent. On roll call vote, the motion carried
unanimously.

MOTION, passed
Mr. Bennett moved and Mrs. Sorum seconded that the chairman be given
authority to extend spraying beyond the three-day period if so requested.
Discussion: Mr. Pawluk said that although the commission is willing to
accommodate this request because of the unusual circumstances, this
type of situation may be avoided in the future by building up runways to
allow for excessive rains. On roll call vote, the motion carried
unanimously.

3.
