<br />4.1 <br /> <br />5.1 <br /> <br />6.1 <br /> <br />6.2 <br /> <br />7.1 <br /> <br />Section 4 <br /> <br />NOTIFICATION OF OPEN FIRES <br /> <br />A person shall notify the Red River Regional Dispatch Center at least twenty four <br />(24) hours prior to initiating, causing, conducting, or permitting open fires in Cass <br />County. Any person who willfully fails to provide said notice may be civilly liable <br />for costs and expenses incurred by a local fire department from responding to a <br />report of said open fires. <br /> <br />Section 5 <br /> <br />ENFORCEMENT <br /> <br />The primary enforcement of this Ordinance shall be the responsibility of the <br />Sheriffs Department of Cass County. <br /> <br />Section 6 <br /> <br />PENAL TIES <br /> <br />Violation of Ordinance. In addition to any other civil or criminal penalty provided <br />by law, any person who shall willfully violate or assist in the violation of an open <br />burning ban imposed under this Ordinance shall be punished as follows: <br /> <br />A. <br /> <br />First offense shall be an infraction with a fine of Fifty Dollars <br />($50.00). <br /> <br />B. <br /> <br />Second offense within one year shall be an infraction with a fine of <br />Two Hundred and Fifty Dollars ($250.00). <br /> <br />C. <br /> <br />Third or subsequent offenses within one year shall be an infraction <br />with a fine of Five Hundred Dollars ($500.00). <br /> <br />Each violation of an open burning ban imposed under this Ordinance shall be <br />considered a separate offense for each day or part of a day during which the <br />violation is committed, continued, or permitted, and subject to a fine. <br /> <br />Section 7 <br /> <br />SEVERABILITY CLAUSE <br /> <br />Should any section, provision or part of this Ordinance be adjudged invalid or <br />unconstitutional, such adjudication should not affect the validity of the Ordinance <br />as a whole or any section, provision or part thereof not adjudged invalid or <br />unconstitutional. <br /> <br />M:\MINUTES\Comm2005\ORDINANCE #2005- BURN BAN DRAFT.doc <br />
