June 20,2005

Jeff Cahill
North Dakota Insurance Reserve Fund
P,O. Box 2258
Bismarck, NO 58502-2258

Re: John Strand v. Cass County
Court File No.: 09-03-C-01068
Cass County Jail and Sheriff's Residence fT

Dear Mr, Cahill: ORA

This is a follow-up to our recent conversation regarding the media's
request for the amount of litigation expenses involved in representing
Cass County in the above-referenced matter. It is my understanding that
NDIRF does not typically release that kind of information to the public
and does not intend to do so in this case.

This matter was addressed at the Cass County Commission's regularly
scheduled meeting today. With deference to NDIRF's policy, the
Commission decided to respectfully request NDIRF provide that
information to Cass County at the conclusion of the litigation. Cass
County could then use the information in whatever manner it deemed
suitable, including providing it to the media.

As you know, on June 10 the jury decided several issues. However, one
issue is still under advisement by the Court. On behalf of Cass County, I
request that once the litigation has concluded NDIRF provide Cass
County a summary of the expenses involved in representing Cass
County in this matter,

If you have any questions, then please feel free to contact me.

Yours Truly,

Birch p, Burdick
State's Attorney
