FIBER LEASE AGREEMENT BETWEEN <br />THE STATE OF NORTH DAKOTA, INFORMATION TECHNOLOGY DEPARTMENT <br />AND CASS COUNTY <br /> <br />This agreement is made and entered into on July 1, 2002, by and between the State of North <br />Dakota, Information Technology Department, hereinafter called ITD, and Cass County. <br /> <br />NOW, THEREFORE, in consideration of the mutual covenants and promises contained herein, <br />the parties agree as follows: <br /> <br />A. Scope of Services: <br /> ITD will lease fiber to Cass County at the following locations: <br /> · West Fargo City Hall, located at 800 4th Ave East, West Fargo <br /> · West Fargo County Shop, located at 1201 West Main Ave, West Fargo <br /> ITD will charge Cass County for connectivity to thc courthouse under our existing model and <br /> this agreement does not include that connection. <br /> <br />B. Term: <br /> This Contract shall be effective for a period commencing on July 1, 2002, and terminating on <br /> June 30, 2007. Charges will begin once the connection is available. Cass County will be <br /> responsible for acquiring all the necessary hardware needed to utilize the fiber. <br /> <br />C. Payments and Invoices: <br /> Cass County agrees to compensate ITD for the leased fiber at the specific rates of $1,400 per <br /> month ( $700 per location ). <br /> <br />Cass County shall be responsible for all charges for 30 months and 15% of the remaining 30 <br />months. These termination charges will apply on a per location basis. <br />(ie: If the contract was cancelled in month 28, Cass County would be responsible for $1,400 x <br />2 = $2,800 plus $1,400 X 15% = $210 x 30 months = $6,300 for a total of $9,100.) <br /> <br />D.
