NDDOT Contract No. Project No. PHSP4100203 SP 01 Ph 08 North Dakota Department of Transportation TRAFFIC SAFETY CONTRACT This contract is between the state of North Dakota, acting by and through its Director of Transporta- tion, hereinafter referred to as NDDOT, whose address is 608 East Boulevard Avenue, Bismarck, North Dakota 58505-0700, and Cass County. Sheriff's Department, hereinafter referred to as the Contractor, whose address is 211 Ninth Street South. Fargo. North Dakota 58107. WHEREAS, NDDOT has been delegated the responsibility to administer the state's Annual Highway Safety Plan as authorized in Section 54-07-05 of the North Dakota Century Code; and WHEREAS, the Contractor requests participation in the state's Annual Highway Safety Plan; THEREFORE, in consideration of the mutual promises herein set forth, NDDOT and the Con- tractor agree: The Contractor shall perform the project(s) set forth in Appendix A, a copy of which is attached hereto and made a part hereof. II. This contract becomes effective when all parties have signed and it shall terminate on September 30. 2002. III. NDDOT shall reimburse the Contractor for costs incurred under the terms of this contract, not to exceed $2.500. Reimbursement of all costs under this contract are contingent on federal partici- pation. Allowable costs are covered under 48 CFR Part 31. All requests for reimbursement must be submitted to NDDOT within 45 days of the termination date of this contract. IV. The Contractor shall make all purchases and maintain and dispose of all equipment purchased in accordance with 49 CFR Parts 18.32 and 18.36 or 23 CFR Part 1204, copies of which will be provided upon request. To ensure that the "Americans With Disabilities Act of 1990" is in compliance during the term of this agreement the Contractor shall adhere to the following: the Uniform Federal Accessibility Standards contained in 41 CFR 101-19.6 (Appendix A), the Americans With Disabilities Act, 36 CFR 1191, the North Dakota Century Code section 48-02-19, and any amendments thereto. VI. The Contractor will comply with all the requirements imposed by 'RUe VI of the Civil Rights Act of 1964 (78 STAT. 252), the regulations of the federal Department of Transportation, 49 CFR, Part 21, and Executive Order 11246.
