NOTICE OF PUBLIC HEARING ON THE ISSUANCE OF CONGREGATE HOUSING REVENUE BONDS UNDER THE MUNICIPAL INDUSTRIAL DEVELOPMENT ACT OF 1955 (FARGO-MOORHEAD FAMILY YMCA PROJECT) NOTICE IS HEREBY GIVEN that the Board of County Commissioners of Cass County, North Dakota, will meet on April 15, 2002, beginning at 3:30 p.m. in the County Commission Room, Cass County Courthouse, Fargo, North Dakota, for the purpose of holding a public heating on a proposal that the County issue revenue bonds under the Municipal Industrial Development Act of 1955, Chapter 40-57, N.D.C.C., in order to finance the project described below. The Project consists of(i) the renovation of the child care facilities located at 400 1st Avenue S, Fargo, (ii) refinancing certain indebtedness incurred to construct and equip the child care facilities, locker rooms and weight training facilities located at 4243 19th Avenue SW, Fargo, and (iii) refinancing certain indebtedness incurred to construct and equip the fitness center located at 400 1st Avenue S., Fargo (the "Project"). The Project is owned and operated by Fargo-Moorhead Family YMCA, Inc., a North Dakota nonprofit corporation. The amount of the proposed bond issue is not to exceed $3,800,000. The bonds shall be limited obligations of the County payable solely from the revenue pledged to the payment thereof, and may be secured by a mortgage or other encumbrances on the Project. No holder of any such bonds shall ever have the fight to compel any exercise of the taxing power of the County to pay the bonds, or the interest thereon, nor to enforce payment against any property of the County except the Project secured thereby. Fargo-Moorhead Family YMCA, Inc. is engaged in the business of owning and operating a exercise, fitness and child care facilities, and competitors are hereby notified of that fact pursuant to Chapter 40-57, N.D.C.C.
