AGREEMENT between the County of Burleigh, State of North Dakota, hereinafter referred to as party of the first part, and the County of Cass , North Dakota hereinafter referred to as party of the second part. Witness, that in consideration of the mutual covenants and agreements herein contained, the parties do hereby agree as follows: The party of the first part agrees to provide jail facilities, if there is room available, for the incarceration of prisoners, and all necessary and incidental services associated with the incarceration of the prisoners at a facility located in Bismarck, North Dakota. Said services shall not include medical care or treatment, and the party of the second part further agrees to indemnify the Burleigh County Sheriff for any necessary expenditures made furnishing same. The party of the second part hereby agrees to pay to the party of the first part for the above services performed, the following rates on a per prisoner per day basis: (1) Daily base rate $40.00 This contract is subject to the provisions of the North Dakota Century Code and all roles and regulations enacted pursuant thereto governing the care and custody of the persons committed hereunder. That this agreemem will continue from year to year unless, and umil one of the parties shall give the other written notice (30) days in advance of their desire to re-negotiate the agreement.
