JOINT POWERS AGREEMENT <br />ELECTRONIC LAND RECORDS MANAGEMENT <br /> <br />1. Parties. The parties to this Joint Powers Agreement are Cass County, North Dakota and the <br /> other entities as listed in Exhibit 1. <br /> <br />2. Authority. This agreement is authorized by Article VII, Section 10 of the North Dakota <br /> Constitution, as implemented by Chapter 54-40.3 of the North Dakota Century Code. <br /> <br />Purpose. The purpose of this agreement is to provide for the operation of a central repository <br />for electronic land records from member counties and to provide for access to those records by <br />electronic means over the Internet. The records stored in the central repository are the <br />property of the county from which they originate, requests for copies of those records, outside <br />of the electronic Internet access, will be referred back to the individual member counties. <br /> <br />Funding. It is the intent that the North Dakota Recorders Information Network, (NDRIN), be <br />funded by uniform, reasonable, electronic access fees, public and private grants and gifts, and <br />$2.00 of the Document Preservation Fee charged by the member counties for recording <br />documents, pursuant to NDCC 11-18-05, until the fee expires. NDRIN members will remit <br />this fee to the host county on a monthly basis. NDRIN will strive to maintain a reserve fund <br />as part of the General Fund equal to 10% of anticipated annual expenditures. Any shortfall in <br />funding shall be prorated amongst the member counties based upon a formula as outlined in <br />Exhibit II. The formula in Exhibit II shall be adjusted annually so to reflect the changing <br />percentage of the number of documents each member county filed as to the total number of <br />documents filed in the preceding calendar year. <br /> <br />5. Management. The management of the central repository shall be provided by Cass County <br /> Government through a contract with an outside vendor or through its own Information Services <br /> Department. <br /> <br />6. North Dakota Recorders Information Network (NDRIN). The NDRIN shall be made up of a <br /> representative from each of the counties participating in this agreement. <br /> <br />7. NDRIN Duties. The NDRIN shall organize itself by electing a chairperson, vice-chairperson, <br /> and secretary each January. The duties of the NDRIN should consist of the following: <br /> <br />a. Preparing and recommending a budget for the NDRIN to the member counties on an <br /> annual basis, no later than August pt of each year. <br /> <br />i. The budget should consider revenues derived from access fees and all the <br /> expenses of maintaining the central repository including equipment, operating <br /> costs, and contracts that are necessary for the operation of the central <br /> repository. <br />ii. The budget should contain travel expenses for committee members to attend <br /> quarterly meetings. <br /> <br />b. Preparing and recommending access fees for accessing central depository data. <br /> <br />c. Preparing an operating plan for the central repository. <br /> <br />d. Make recommendations to the Cass County Commission on all vendor contracts. <br /> <br /> <br />
