Payroll <br /> <br />December 24, 2004 <br /> <br />Cass County Government / Personnel <br />Attention: Mike Montplaisir <br />211 9th Street S. <br />Fargo, ND 58108 <br /> <br />Dear Mike: <br /> <br />Your company's Plan Document is an important part of your Flexible Benefits Program and is reviewed by <br />Discovery Benefits at least once a year for any language updates due to changes in legislation or interpretation in <br />Section 125 and related regulations. <br /> <br />For the 2005 plan year, your company's plan document includes the following updates: <br /> <br />. <br /> <br />Language stating that checks not cashed after the run out period selected for your Plan are considered to be <br />forfeited funds. Discovery Benefits will include in its forfeited fund calculation unclaimed fund amounts that <br />have been issued but remain unendorsed. This language is included in Paragraphs 6.3 and 7.8. <br /> <br />. <br /> <br />If your company offers a Flex Debit card, there is language incorporating the card into your plan. The language <br />is drafted to comply with IRS Revenue Ruling 2003-43 and is found in Paragraph 6.8. <br /> <br />. <br /> <br />Language that allows for the reimbursement of over-the-counter medicines and drugs. This language is found <br />in Paragraph 6.2(d). <br /> <br />. <br /> <br />Language stating terminated employees may only submit claims within a set time frame from the date of <br />termination instead of from the end of the plan year. This language can be found in Paragraph 6.7(c) and <br />7.I2(i). <br /> <br />. <br /> <br />Language has been updated to comply with HIP AA Privacy Standards. This language can be found in <br />Paragraph 11.17. <br /> <br />. <br /> <br />Language has been added to comply with the changes to the definition of "dependent" from the Working <br />Families Tax Relief Act of 2004 (WFTRA), to handle Qualified Medical Child Support Orders. This language <br />can be found in the Plan Document, Paragraph 1.7, the Summary Plan Description, Article IV, Dependent Care <br />Assistance, Paragraph 2 and Article IX, item 3 (Qualified Medical Child Support Order). <br /> <br />. <br /> <br />Language has been added to comply with the new COBRA regulations. This language can be found in the <br />Summary Plan Description, Article X. <br /> <br />As always, we recommend that the documents be reviewed by your legal counsel before execution. <br /> <br />A copy of the Summary Plan Description should be provided to all participants within 120 days of the beginning of <br />the plan year. We can provide an electronic version of the Summary Plan Description if you would like to post it on <br />your intranet.
