<br />others, or property or becomes abnormally burdensome financially, medically, supervisorally, or <br />otherwise. If the SCCC deems an inmate of the neighbor county abnormally burdensome or <br />abnormally dangerous it may refuse receipt of the inmate, or if the condition develops after <br />SCCC's initial receipt of custody, notifY the neighboring county of the determination and direct <br />the neighboring county to appear at the SCCC and resume custody of the inmate. Reversion of <br />custody back to the Neighbor County may constitute a considerable burden on the Neighbor <br />County who likely does not have provisions in place for such an inmate at another facility. <br />Additionally, Neighbor County, has pursuant to this agreement agreed to hold harmless and <br />indemnify the GA et a1. Consequently, refusal is to be exercised only under very serious <br />circumstances and the parties may wish to consider re-negotiating another per diem rate for the <br />particular inmate instead of refusal. <br /> <br />10. Compensation ../ PO <br />Neighbor County will pay Stutsman County $5.:.; . per day per inmate. This rate applies <br />to every 24 hour period (midnight to midnight) and to one partial period on the beginning or end <br />of the contiguous primary block. Neighbor County acknowledges that this negotiated rate is <br />facilitated by Neighbor County's agreement to retain financial liability and indemnify SCCC. <br />Without Neighbor County's willingness to accept those burdens, the negotiated per diem rate <br />would be substantially higher. <br /> <br />II. Transport <br />Neighbor County is responsible for transporting its inmates and detainees to and from the SCCC, <br />initially, finally, and as needed intermittently for court appearances in the Neighbor county or any <br />other trip ordered or necessary that exceeds 10 miles round trip from the SCCC. The GA will <br />transport as needed within the city limits of Jamestown. Note exception below for ambulance <br />servICes. <br /> <br />12. Right of Entry <br />Neighbor County is given right to enter the SCCC under reasonable conditions and subject to <br />SCCC policy to inspect the SCCC and the inmate's condition. <br /> <br />13. Expenses of Diagnosis and Treatment <br />Neighbor County is fully financially responsible for the costs and expenses stemming from or <br />associated with diagnosis and/or treatment of medical, psychological, and/or addiction conditions <br />of the Neighbor County's inmate. The Neighbor County is financially responsible for these <br />services whether the inmate or detainee was malingering or suffering from an authenticated <br />condition; whether the initial recognition of the condition was by the inmate or SCCC staff; and <br />whether the costs or expenses were incurred at the SCCC, in transport, at a treatment facility, or <br />when otherwise in the custody of the SCCC. Although SCCC may be required by law, policy, <br />rules or regulation to provide these services for anyone in its facility, the Neighbor County agrees <br />to pay the full cost and expenses billed by the service provider for services rendered to the <br />Neighbor County's inmate or detainee. Neighbor County is responsible for costs of ambulance <br />transport to treatment provider even if the transport is to a facility inside the city limits of <br /> <br />2 <br />
