<br />Commission Minutes--November 29, 2004 <br /> <br />2823 <br /> <br />SPECIAL MEETING OF CASS COUNTY BOARD OF COMMISSIONERS <br />MEETING IN EXECUTIVE SESSION <br />NOVEMBER 29, 2004 <br /> <br />1. <br /> <br />MEETING TO ORDER <br />A meeting of the Cass County Board of Commissioners was called to order by the <br />Chairwoman, Robyn Sorum, at 9:40 AM at the Vogel Law Firm, 218 NP Avenue, Fargo, <br />North Dakota. Four members were present as follows: Scott Wagner, Vern Bennett, <br />Robyn Sorum and John Meyer. Darrell Vanyo was absent. <br /> <br />Also present were Craig Campbell, Vogel Law Firm; Birch Burdick, State's Attorney; County <br />Auditor Michael Montplaisir; County Coordinator Bonnie Johnson; Administrative Assistant <br />Joyce Schepp; Architects T.L. Stroh and Rick Hoganson. <br /> <br />2. <br /> <br />MEETING CLOSED AT 9:43 AM FOR ATTORNEY/CLIENT CONSULTATION <br />A notice of today's meeting was faxed at 9: 15 AM today to members of the local media <br />indicating the Cass County Board of Commissioners will meet in executive session for the <br />purpose of discussing pending civil litigation or adversarial administrative proceedings <br />based on North Dakota Century Code 44-04-19.1, the exceptions allowed for attorney <br />consultation and/or negotiation. The issue to be discussed with the county's legal counsel <br />is the Strand v. Cass County lawsuit. <br />MOT/ON, passed <br />Mr. Wagner moved and Mr. Meyer seconded to close the meeting <br />at 9:43 AM to go into executive session for the purpose of <br />consulting with legal counsel in regard to pending litigation in the <br />matter of Strand v. Cass County. On roll call vote, motion carried <br />unanimously. <br /> <br />3. <br /> <br />EXECUTIVE SESSION CLOSED/MEETING ADJOURNED <br />MOT/ON, passed <br />Mr. Wagner moved and Mr. Meyer seconded to go back into open session <br />at 12:30 PM.
