2. Second reading-ordinance to police public events

REVISED 10-10-2014 CASS COUNTY ORDINANCE #2014-1 (AUTHORIZATION OF SHERIFF TO POLICE PUBLIC EVENTS) Purpose The purpose of this Ordinance to promote the safe enjoyment of public events throughout the county by authorizing the sheriff to police such events. Definitions "Car race" means a competition that is (1) used to determine which vehicle is fastest in covering a set course, and (2) held open to the public at a location having a capacity of at least one hundred people. "Car show" means any public exhibition of vehicles at a location having a capacity of at least one hundred people. "Music festival" means a musical performance by one or more groups held out of doors with the audience being present primarily for the purpose of listening to music. "Public concert" means a musical performance by one or more groups held indoors where the audience is seated by reserve or general admission with the audience being present primarily for the purpose of listening to music and the location of such musical performance having a seating capacity of at least one thousand people. "Public dance" means any dance where the public may participate and is present primarily for the sole purpose of dancing and where the location of the dance has a capacity of at least one hundred people. "Public event"means an occurrence held open to the public at a location having a capacity of at least one hundred people, and includes a car race, car show, music festival, public concert, public dance, and rodeo, but does not include a neighborhood block party, a church event, or any event limited to invited persons. "Rodeo" means any sporting event that is (1) comprised of contests designed to test the skill of participants and involving horses, livestock, or both, and (2) held open to the public at a location having a capacity of at least one hundred people. "Vehicle" includes every device in, upon, or by which any person or property may be transported or drawn upon a public highway, except devices moved by human power or used exclusively upon stationary rails or tracks.
