FOURTH AMENDED COOPERATIVE AGREEMENT <br /> FOR THE OPERATION <br /> OF THE CLAY COUNTY <br /> SECURE JUVENILE DETENTION AND <br /> TREATMENT FACILITY <br /> THIS AGREEMENT is made and entered into this day of <br /> 2014, by and between the Minnesota Counties of Clay, Becker, Douglas, Grant, Otter <br /> Tail, Stevens, Todd, Traverse, Wadena, and Wilkin, as well Cass County, North <br /> Dakota; and <br /> WHEREAS, the undersigned counties have determined that it is mutually <br /> beneficial for the counties to cooperatively address their long-term needs for secure <br /> juvenile detention and treatment facility capacity; and <br /> WHEREAS, the initial Member Counties entered into a cooperative <br /> services agreement in 2009 in order to keep the Facility open and to adopt a new <br /> payment and voting structure in order to help ensure the facility is economically <br /> viable so the Member Counties may continue to rely on it for the placement of its <br /> juveniles; and <br /> WHEREAS, at the time of the initial cooperative agreement the parties <br /> had agreed to a per diem purchase of beds or a per bed purchase plan, outlined in <br /> full in the cooperative services agreement. The per diem option was subsequently <br /> eliminated for Member Counties. The Member Counties now purchase only on <br /> an annual per bed basis. Those counties not willing to enter into an annual <br /> agreement may still use the facility but they do not get transportation as part of the <br /> rate and pay a higher non-member per diem rate; and <br /> WHEREAS, Cass County, North Dakota is located adjacent to Clay <br /> County, Minnesota and is only minutes from the Clay County Secure Juvenile <br /> Detention and Treatment Facility. It is mutually beneficial for Cass County, North <br /> Dakota and the Minnesota Member Counties to cooperatively address their long- <br /> term needs for secure juvenile detention and treatment needs by allowing Cass <br />
