2. Clay County juvenile detention agreement

FOURTH AMENDED COOPERATIVE AGREEMENT FOR THE OPERATION OF THE CLAY COUNTY SECURE JUVENILE DETENTION AND TREATMENT FACILITY THIS AGREEMENT is made and entered into this day of 2014, by and between the Minnesota Counties of Clay, Becker, Douglas, Grant, Otter Tail, Stevens, Todd, Traverse, Wadena, and Wilkin, as well Cass County, North Dakota; and WHEREAS, the undersigned counties have determined that it is mutually beneficial for the counties to cooperatively address their long-term needs for secure juvenile detention and treatment facility capacity; and WHEREAS, the initial Member Counties entered into a cooperative services agreement in 2009 in order to keep the Facility open and to adopt a new payment and voting structure in order to help ensure the facility is economically viable so the Member Counties may continue to rely on it for the placement of its juveniles; and WHEREAS, at the time of the initial cooperative agreement the parties had agreed to a per diem purchase of beds or a per bed purchase plan, outlined in full in the cooperative services agreement. The per diem option was subsequently eliminated for Member Counties. The Member Counties now purchase only on an annual per bed basis. Those counties not willing to enter into an annual agreement may still use the facility but they do not get transportation as part of the rate and pay a higher non-member per diem rate; and WHEREAS, Cass County, North Dakota is located adjacent to Clay County, Minnesota and is only minutes from the Clay County Secure Juvenile Detention and Treatment Facility. It is mutually beneficial for Cass County, North Dakota and the Minnesota Member Counties to cooperatively address their long- term needs for secure juvenile detention and treatment needs by allowing Cass
