<br />GRANT AGREEMENT <br /> <br />WHEREAS, the Division of Juvenile Services (DJS) of the North Dakota Department of <br />Corrections and Rehabilitation has determined the services referred to in the paragraph below <br />entitled "Scope of Services" form an appropriate basis for the expenditure of Federal grant funds <br />(CFDA number 16.548) from the Office of Juvenile Justice and Delinquency Prevention (OJJDP); <br />and <br /> <br />WHEREAS, the North Dakota Association of Counties (NDACo) has agreed to assist DJS in <br />obtaining, coordinating, supervising, and/or administrating these services; and <br /> <br />WHEREAS, Cass County (GRANTEE) proposes to provide those services. <br /> <br />NOW, THEREFORE, the parties enter into the following: <br /> <br />AGREEMENT <br /> <br />I. TERM OF THE GRANT <br />The term of this agreement shall be from July 1, 2004 through September 30,2005. <br /> <br />IT. SCOPE OF SERVICES <br />The GRANTEE shall operate an unruly diversion project as described in GRANTEE'S <br />proposal (Attachment A). <br /> <br />ID. COMPENSATION <br />DJS agrees to grant and pay to the GRANTEE a sum not to exceed the amount of $23,000 <br />for the services referenced in the Scope of Services, during the term of this agreement. <br /> <br />The GRANTEE agrees to account for any and all grant funds that may be in possession of <br />the GRANTEE throughout the term of this grant and to return any unexpended grant funds <br />within 30 days after final closing of the grant. However, the balance of the unexpended <br />funds can be reallocated into a new contract, at the request of the NDACo or DJS, <br /> <br />The GRANTEE agrees to provide the applicable match for the project, as described in <br />GRANTEE'S proposal (Attachment A). <br /> <br />N, GRANTEE ASSURANCES <br />The GRANTEE agrees to comply with the grant conditions and assurances established by <br />OJJDP for sub-grant recipients of federal funds as detailed in the Office of Justice Programs <br />Financial Guide and associated Federal Circulars. <br /> <br />The GRANTEE agrees to comply with the nondiscrimination requirements of the Omnibus <br />Crime Control and Safe Streets Act of 1968, as amended, 42 USC 3789d(c); Title VI ofthe <br />Civil Rights Act of 1964, as amended; Section 504 of the Rehabilitation Act of 1973, as <br />amended; Title IT of the Americans With Disabilities Act; Title IX of the Education <br /> <br />1 <br />
