GRANT AGREEMENT WHEREAS, the Division of Juvenile Services (DJS) of the North Dakota Department of Corrections and Rehabilitation has determined the services referred to in the paragraph below entitled "Scope of Services" form an appropriate basis for the expenditure of Federal grant funds (CFDA number 16.548) from the Office of Juvenile Justice and Delinquency Prevention (OJJDP); and WHEREAS, the North Dakota Association of Counties (NDACo) has agreed to assist DJS in obtaining, coordinating, supervising, and/or administrating these services; and WHEREAS, Cass County (GRANTEE) proposes to provide those services. NOW, THEREFORE, the parties enter into the following: AGREEMENT I. TERM OF THE GRANT The term of this agreement shall be from July 1, 2004 through September 30,2005. IT. SCOPE OF SERVICES The GRANTEE shall operate an unruly diversion project as described in GRANTEE'S proposal (Attachment A). ID. COMPENSATION DJS agrees to grant and pay to the GRANTEE a sum not to exceed the amount of $23,000 for the services referenced in the Scope of Services, during the term of this agreement. The GRANTEE agrees to account for any and all grant funds that may be in possession of the GRANTEE throughout the term of this grant and to return any unexpended grant funds within 30 days after final closing of the grant. However, the balance of the unexpended funds can be reallocated into a new contract, at the request of the NDACo or DJS, The GRANTEE agrees to provide the applicable match for the project, as described in GRANTEE'S proposal (Attachment A). N, GRANTEE ASSURANCES The GRANTEE agrees to comply with the grant conditions and assurances established by OJJDP for sub-grant recipients of federal funds as detailed in the Office of Justice Programs Financial Guide and associated Federal Circulars. The GRANTEE agrees to comply with the nondiscrimination requirements of the Omnibus Crime Control and Safe Streets Act of 1968, as amended, 42 USC 3789d(c); Title VI ofthe Civil Rights Act of 1964, as amended; Section 504 of the Rehabilitation Act of 1973, as amended; Title IT of the Americans With Disabilities Act; Title IX of the Education 1
