Approve to transfer a balance of $112,923.07 from the Chrisan Subdivision Specials <br /> Fund to Stanley Township. <br /> e. Authorize the closing of County Road 17 from 7:00 AM on August 16, 2014, until 1:00 <br /> AM on Sunday, August 17, 2014, for the Horace Bean Days community celebration. <br /> f. Approve calendar raffle permit for Red River Valley Kart Association to be held July 14, <br /> 2014, through September 15, 2014, at the Red River Valley Fairgrounds go kart track in <br /> West Fargo, North Dakota. <br /> g. Authorize the county engineer to dispose of excess equipment at public auction. <br /> h. Contract approval <br /> - Flood lot lease for 2014; <br /> - Mosquito spraying—City of Harwood, Braaten Subdivision and Highland Park <br /> Subdivision. <br /> 6. RESOLUTION #2014-9, Declaring the Necessity to Create the Garsteig-Embden <br /> Maintenance District <br /> Sean Fredricks, Attorney from Ohnstad Twichell; Mike Opat from Moore Engineering; <br /> Rodger Olson, Maple River Water Board Chairman; and Jurgen Suhr, Maple River Water <br /> Board Manager were present to discuss creation of the Garsteig-Embden Maintenance <br /> District. This item was initially brought to the commission this past February when Maple <br /> River Water Resource District (WRD) was in the beginning stages of the process to create <br /> the district. <br /> Mr. Fredricks said the Soil Conservation Service constructed the Garsteig Dam, Embden <br /> Dam and other channel improvements several decades ago, and does not maintain the <br /> facilities; therefore, the Maple River WRD is obligated to maintain them. North Dakota <br /> Century Code allows water resource districts to create "federal maintenance districts" to <br /> generate revenue for project operation and maintenance. The process is not vote-driven <br /> because the state legislature recognizes most landowners will not vote to assess <br /> themselves for projects that are already built. <br /> Maple River WRD held a public hearing on June 5, 2014, and on June 25, 2014, approved a <br /> resolution declaring the necessity to create the maintenance assessment district. Mr. <br /> Peterson asked about comments received from the public. Mr. Pawluk attended the hearing <br /> and said no objections were given regarding the project. The chairman asked if anyone in <br /> the audience today wished to be heard, and no one present had any comments. <br /> MOTION, passed <br /> Mr. Bennett moved and Mrs. Scherling seconded to adopt Resolution <br /> #2014-9 Declaring the Necessity to Create the Garsteig-Embden <br /> Maintenance District: Mr. Pawluk believes the appropriate notice was <br /> given regarding the public hearing, but has some concerns that <br /> residents may not be aware of the maintenance district being created <br /> until they receive their property tax statements. On roll call vote, the <br /> motion carried unanimously. <br />
