<br />H. <br /> <br />No person shall perform body art upon any person who is under the <br />influence of either alcohol, drugs or other stimulants or <br />depressants, or any person of unsound mind. <br /> <br />Section 7. Penalty.-Every person, firm or corporation violating this article <br />shall, upon conviction thereof, be punished by a fine not to exceed $1000 or by <br />imprisonment not to exceed 30 days, or by both such fine and imprisonment, in <br />the discretion of the Court, the Court to have power to suspend said sentence <br />and to revoke the suspension thereof. All fines shall be paid to the Cass County <br />Treasurer. <br />Section 8. Effective Date.--This ordinance shall be in full force and effect <br />from and after its passage, approval and publication. <br /> <br />Section 9. Severability.- <br />A. With the passage of the ordinance, the entire county will be covered by a <br />uniform body art ordinance which will apply within the boundaries of Cass County, <br />except that this ordinance will not supercede any ordinance of any political <br />subdivision without its consent nor establish an ordinance in any incorporated <br />political subdivision without its consent. <br />B.
