RRRDC, Clay County and Moorhead's use of the Computer Aided Dispatch and Records Management System, is limited to the use by said entities for appropriate law enforcement- related and public safety-related functions. RRRDC, Clay County, Cass County and Moorhead shall not allow the use of the Computer Aided Dispatch and Records Management System by any other person, firm or entity, including any private or public law enforcement or public safety agency or political subdivision, without the written consent of Fargo. It is understood that Cass County has a separate written agreement by which they are authorized by Fargo to access to, and use of, the Computer Aided Dispatch and Records Management System. 9. Authorized Use--F-M Ambulance. F-M Ambulance shall cooperate with Fargo in protecting the copyright or copyrights of Fargo regarding the Computer Aided Dispatch and Records Management System at no cost to F-M Ambulance and shall not allow the use of the Computer Aided Dispatch and Records Management System by any other person, firm or entity, including any private or public law enforcement or public safety agency or political subdivision, without the written consent of Fargo. 10. Warranties. None of the parties hereto make any warranties with respect to the use, sale or other transfer of the Computer Aided Dispatch and Records Management System by the other party or by any third party. In no event will Fargo be liable for direct, indirect, special, incidental or consequential damages that are in any way related to the use or access of the Computer Aided Dispatch and Records Management System by RRRDC, Cass County, Clay County and Moorhead. 11. Data Privacy/Control of Data. Each party shall be responsible for controlling access to the Computer Aided Dispatch and Records Management System by its employees so that the information and data maintained in the Computer Aided Dispatch and Records Management System is used for legitimate law enforcement purposes and shall defend, indemnify and hold the other party harmless, from any claims, demands or lawsuits brought by any person, firm or entity resulting from the misuse by an employee or agent of the first party of information or data maintained in the Computer Aided Dispatch System. ,..{ Deleted: J..I.:!. - -~1]X()!.1J:1~~i_()!l- ~1] ~. ~~!~. !~-~ ~i-'~T~~_}~ - ~- ~~g - ~()- -~QÇ - ~1]-~~! - ~- _~i~p~!~~ - f!~~ - ßß13.PÇ- /'- shall belong to. and be under the control of, the non-RRRDC party to this agreement to which the call is directed or referred or to the non-RRRDC ?arty that.is asked to res?ond to the call by a dispatch of RRRDC In the event that more than one non-RRRDC party hereto is involved in said call and/or dispatch, then said information and data shall belong to. and be under the control of. each of such involved non-RRRDC parties. Information and data exchanged via RRRDC between the non-RRRDC parties shall belong to. and be under the control of. those non-RRRDC parties making such exchange. RRRDC shall not be an owner, nor have control over, such data or information. By signature hereto. Cass County also agrees to the terms of this paragraph. 12. Amendment. This agreement may be modified or amended if the amendment is made in writing and assigned by both parties. 13. Severability. If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable.
