The settlement amount was based on Cass County's actual <br /> costs. <br /> It is the request of BNSF Railway that Cass County sign and accept the <br /> above specified amount and release and forever discharge BNSF Railway <br /> from all claims and liabilities of every kind or nature arising out of the <br /> incident on or about December 30, 2013 at or near Casselton, ND.
