JOINT RESOLUTION DETERMINING BENEFITTED PROPERTY <br /> REGARDING UPPER MAPLE FLOOD PROTECTION DISTRICT NO. 1 PROJECT <br /> AND SETTING HEARING <br /> WHEREAS, the Maple-Steele Joint Water Resource District (the"District") and the <br /> Barnes County Water Resource District ("Barnes WRD") have jointly concluded it is necessary <br /> to develop plans and specifications regarding the design of the UPPER MAPLE FLOOD <br /> PROTECTION DISTRICT No. 1 PROJECT (the "Project"); to acquire right of way as necessary to <br /> accommodate the Project; to create the UPPER MAPLE FLOOD PROTECTION DISTRICT No. 1 <br /> assessment district; and to ultimately construct, operate, manage, and maintain the Project, in <br /> accordance with Chapter 61-16.1 of the North Dakota Century Code. <br /> WHEREAS, the District, Barnes WRD, and their agents have inspected any and all lots, <br /> pieces, or parcels of land which would benefit from the Project and may be subject to <br /> assessments for construction of the Project, including properties in Carpenter Township in Steele <br /> County; Ellsbury Township in Barnes County; and Rochester, Lake, Cornell, and Tower <br /> Townships in Cass County. <br /> NOW THEREFORE, BE IT RESOLVED that the District and Barnes WRD have <br /> determined the particular lots, pieces, and parcels of land that will benefit from the construction <br /> of the Project, and the parties have prepared a preliminary list of the benefits, the assessment <br /> cost, and the percentage assessments regarding each tract of land that will benefit from the <br /> proposed project; the preliminary list includes properties in portions of Carpenter Township in <br /> Steele County; Ellsbury Township in Barnes County; and Rochester, Lake, Cornell, and Tower <br /> Townships in Cass County. <br /> BE IT FURTHER RESOLVED that the District and Barnes WRD hereby jointly adopt <br /> and approve the preliminary list of benefits and assessments regarding the Project and regarding <br /> UPPER MAPLE FLOOD PROTECTION DISTRICT NO. 1; the preliminary list is on file with the <br /> District's Secretary-Treasurer. <br /> BE IT FURTHER RESOLVED that the District and Barnes WRD will levy a <br /> maintenance levy against the benefitted properties within the assessment district from time to <br /> time as necessary in accordance with N.D. Cent. Code Section 61-16.1-45 for purposes of <br /> operating, repairing, maintaining, and improving the Project. <br /> BE IT FURTHER RESOLVED that the District and Barnes WRD will conduct a hearing <br /> regarding UPPER MAPLE FLOOD PROTECTION DISTRICT NO. 1, and at least 10 days before the <br /> hearing, the District will file with the Steele, Barnes, and Cass County Auditors a list showing <br /> the percentage assessments against each tract of land that will benefit from the Project and the <br /> corresponding estimate of assessments for each parcel. <br /> BE IT FURTHER RESOLVED that the District and Barnes WRD will mail and file the <br /> assessment list and will mail notice as required by law regarding the Project hearing for UPPER <br /> MAPLE FLOOD PROTECTION DISTRICT NO. 1; the District and Barnes WRD set April 2, 2014, at <br /> 10:00 a.m., at the Page Auditorium in Page, North Dakota, as the date and place for the public <br /> hearing regarding the Project and regarding the UPPER MAPLE FLOOD PROTECTION DISTRICT <br /> No. 1 assessment district. Affected landowners will have 30 days after the date of the hearing to <br />
