Commission Minutes--August 23, 2004 2782 SPECIAL MEETING OF CASS COUNTY BOARD OF COMMISSIONERS MEETING IN EXECUTIVE SESSION AUGUST 23, 2004 1. MEETING TO ORDER A special meeting of the Cass County Board of Commissioners was called to order by the Chairwoman, Robyn Sorum, at 1 :03 PM in the Commission Room, Cass County Courthouse. All members were present as follows: John Meyer, Darrell Vanyo, Scott Wagner, Vern Bennett and Robyn Sorum. Birch Burdick, State's Attorney, was also present and noted the presence of County Auditor Michael Montplaisir, County Engineer Keith Berndt, County Coordinator Bonnie Johnson and Administrative Assistant Joyce Schepp. 2. MEETING CLOSED AT 1 :05 PM FOR ATTORNEY/CLIENT CONSULTATION Mrs. Sorum said the meeting was called today for the purpose of attorney consultation and/or negotiation. Three issues to be discussed with the county's legal counsel include Strand, et al v. Cass County; Agriculture Department administrative complaint; and Labor Department administrative complaint. MOTION, passed Mr. Wagner moved and Mr. Vanyo seconded to close the meeting at 1 :05 PM to discuss pending civil litigation and adversarial administrative proceedings based on North Dakota Century Code 44- 04-19.1, the exceptions allowed for attorney consultation and/or negotiation, with the following topics to be discussed: Strand, et al v. Cass County; Agriculture Department complaint and labor Department complaint. On roll call vote, motion carried unanimously. 3. ADJOURNMENT The meeting was opened to the public at 2:07 PM. Mr. Burdick indicated the executive session was intended for information purposes, and he is not asking for any specific decision that would require a vote of the board members today.
