FOURTH AMENDMENT TO THE THIRD AMENDED AND RECONSTITUTED JOINT POWERS AGREEMENT (RED RIVER REGIONAL DISPATCH CENTER) THIS AMENDMENT is made and entered into effective the 11th day of December,2013,by and between the CITY OF FARGO,NORTH DAKOTA,a municipal corporation,hereinafter called"Fargo", the CITY OF WEST FARGO, NORTH DAKOTA,a municipal corporation,hereinafter called"West Fargo",the CITY OF MOORHEAD,MINNESOTA, a Minnesota municipal corporation,hereinafter called "Moorhead",the COUNTY OF CASS, (sometimes designated"Cass County Government), a corporate body and county under the laws of the State of North Dakota, hereinafter called"Cass County", and CLAY COUNTY,MINNESOTA,a corporate body and county under the laws of the State of Minnesota,hereinafter called"Clay County". WITNESSETH: WHEREAS,the parties hereto have entered into a Third Amended and Reconstituted Joint Powers Agreement for the establishment of the"Red River Regional Dispatch Center",hereinafter referred to as"RRRDC"which was further amended the 14th day of September, 2010 [the First Amendment to the Third Amended and Reconstituted Joint Powers Agreement],the 14th day of September, 2011 [the Second Amendment to the Third Amended and Reconstituted Joint Powers Agreement] and the 11th day of July,2012 [the Third Amendment to the Third Amended and Reconstituted Joint Powers Agreement], said agreement, as amended being referred to herein as the "Joint Powers Agreement"; and, WHEREAS,the parties wish to further amend the Joint Powers Agreement to authorize the purchase of the condominium space currently being occupied by the RRRDC; and, WHEREAS,the parties wish to request that the city of Fargo to issue the debt necessary to fund said purchase and to advance said funds to the RRRDC for said purpose; and, WHEREAS,the city of Fargo has stated that it is willing to issue the debt necessary for said purchase, and is willing to enter into the necessary agreement with the board of authority of the RRRDC to establish the source of repayment of said debt; and, WHEREAS,the parties wish to authorize the board of authority of the RRRDC to enter into said agreement for said repayment;
