4. Captions: The captions on the paragraphs and subparagraphs of this <br /> Agreement are inserted only for the purpose of convenient reference. The <br /> caption shall not be used to construe or interpret the Agreement or to <br /> prescribe the scope or intent of the Agreement. <br /> 5. Severability: The invalidity or unenforceability of any particular provision <br /> of this Agreement shall not effect its other provisions. This Agreement <br /> shall be construed in all respects as if such invalid or unenforceable <br /> provision was omitted. <br /> 6. Entire Agreement: This Agreement constitutes the complete and entire <br /> understanding of the parties concerning the conveyance of the property. <br /> Neither party shall be bound by or be liable for any statements, warranties, <br /> guarantees or representations not set forth in this Agreement which have <br /> been made by any other person representing or purporting to represent a <br /> party of this Agreement. <br /> 7. Modification: No change or modification of this Agreement shall be valid <br /> unless the same shall be in writing and signed by all the parties of this <br /> Agreement. <br /> 8. Covenants to Run with Property: All covenants, terms and conditions in <br /> this Agreement shall run with the property. <br /> 9. Persons Bound By This Agreement: This Agreement shall be binding <br /> upon the parties and their successors in interest. The rights and <br /> obligations of any party to this Agreement may be exercised or satisfied by <br /> that party's legal representative. <br /> 10. Governing Law: The provisions of this Agreement shall be governed by <br /> the laws of the State of North Dakota. <br /> 11. Effective Date: This Agreement is made and shall be effective November <br /> 15, 2010, regardless of the various dates the parties may have negotiated, <br /> executed, or otherwise carried out the terms and conditions of this <br /> Agreement. <br /> In witness of its terms and conditions, the parties have executed this Agreement. <br /> Dated this 11 day of 'N o cw, r 2013. <br /> rcha <br /> ser— David A.
