<br />problems between social service and other county employees based on the county salary <br />administration plan. Human Resource Management Services determined that that was <br />not allowed under current law. A task force was established in January to develop a <br />legislative proposal that would be permissive to allow a county or group of counties to <br />establish a local merit system. This option is used in several other states. This task force <br />included representatives of county commissioners, the Department of Human Services, <br />Human Resource Management Services, the ND Association of Counties, county social <br />service directors, ND Public Employees Association. The task force has developed and <br />given a presentation on key issues, drafted a sample set of administrative rules and <br />possible Century Code. <br /> <br />The advantages of the proposed legislation are that it is permissive and includes <br />mechanisms to assure compliance with federal requirements and would allow county <br />employees to be covered by one policy and assure internal equity. Potential <br />disadvantages are that there could be inequities for social service employees between <br />counties, there would be a loss of transferability between counties for employees and a <br />local Merit System would require significant work by counties to assure compliance with <br />federal/state laws. <br /> <br />Resolution adopted in 2004 by Cass County <br />Merit System Opt-out proposal <br /> <br />2004 Merit System Opt-Out Proposal In order to insure internal equity for employees, <br />Cass County urges the ND Legislature to support permissive legislation to allow counties <br />to establish a local Merit System. <br />
