Century Code Excerpts <br /> DISASTER ACT <br /> NDCC 37- 17.1 -03, paragraph 4 <br /> Limitations <br /> Nothing in this chapter may: <br /> Limit, modify, or abridge the authority of the governor to proclaim martial law, provide aid or assistance <br /> to civil authorities, or exercise any other powers vested in the governor under the Constitution of North <br /> Dakota, or statutes, common law, or sovereign powers of this state independent of, or in conjunction with, <br /> any provisions of this chapter. <br /> NDCC 37- 17.1 -05, paragraph 6.e <br /> The Governor and disasters or emergencies Penalty <br /> Direct and compel the evacuation of all or part of the population from any stricken or threatened area <br /> within the state if the governor deems this action necessary for the preservation of life or other disaster or <br /> emergency mitigation, response, or recovery. <br /> NDCC 37- 17.1 -10, paragraph 1 <br /> Local disasters or emergencies Penalty <br /> Unless so declared in accordance with the provisions of subsection 4 of section 37- 17.1 -05, a local <br /> disaster or emergency may be declared only by the principal executive officer of the county or city. For <br /> the purpose of preventing the escape and release of an animal injurious to or competitive with agriculture, <br /> horticulture, forestry, wild animals, and other natural resource interests, the board may, by rule, <br /> quarantine any such animal, cause any such animal to be killed, regulate or prohibit the arrival in or <br /> departure from this state of any such animal, and at the cost of the owner thereof, the board may detain <br /> 17 <br />
